Kindness is not soft. It is smart. And in law and business, it has real commercial value.
There is a persistent assumption in business, and particularly in debt collection, that firmness requires harshness. That to be taken seriously, you must be aggressive. That softness is a liability.
In my experience, the opposite is true. Unkindness prolongs disputes. It entrenches resistance. It destroys relationships that could have been preserved, and costs far more than it should in time, money, and reputation.
What kindness actually means in practice
Kindness in a professional context is not about avoiding difficult conversations or letting people off the hook. It is not about being a pushover or abandoning accountability. It is about delivering truth with respect, holding your position firmly while treating the person across the table as a human being.
A debtor who feels humiliated or cornered will avoid, resist, and delay. A debtor who feels respected, even in a difficult situation, is far more likely to engage, communicate, and ultimately cooperate. The approach does not change the obligation. It changes the outcome.
The real returns of a respectful approach
It builds trust. People do business with, and pay, those they trust. A respectful engagement builds the kind of credibility that aggressive tactics erode.
It defuses conflict. Tension escalates when people feel attacked. A calm, measured tone de-escalates situations that would otherwise spiral into costly disputes.
It protects value. Relationships have commercial value. Preserving them, even through a difficult recovery process, protects future business that hostility would permanently close off.
Why I believe this, and practise it
In my work in debt collection, I have seen firsthand that treating debtors with empathy and respect consistently yields the best results, outcomes that are lawful, efficient, and relationship-smart. The matters that resolve most smoothly, most quickly, and most cost-effectively are almost always those where both sides were treated with basic human dignity throughout.
Kindness is not weakness. It is strength, quietly practised and powerfully felt. It turns conflict into cooperation and restores value where tension erodes it.
How we treat people matters. Even in business. Especially in business.
